What is the Film Censorship?

Background:

Granting Revisionary Powers: The authorities, on account of violation of Section 5B(1) of the Cinematograph Act, 1952, can order for “re-examination” via the certification board of an already licensed movie, following receipt of complaints.

  • Section 5B(1) deals with the standards for steerage in certifying movies. It results from Article 19(2) of the Constitution and is non-firm.
  • Under Section 6 of the present Cinematograph Act, 1952, the Centre already empowers to name for the file of proceedings regarding certification of a movie and bypass any order thereon.

Central Board of Film Certification (CBFC):

  • It is a statutory frame underneath the Ministry of Information and Broadcasting. Regulating the public exhibition of movies beneath the provisions of the Cinematograph Act 1952.
  • The Board consists of non-reputable individuals and a Chairman (all appointed via Central Government) and features head office at Mumbai.
  • Films can be publicly shown in India (on cinema halls, T.V. Channels) only once licensed through the Central Board of Film censorship Certification.

A Gift, Movies are Licensed Beneath four Classes: U, U/A, A& S.

  • Unrestricted Public Exhibition (U)
  • Unrestricted Public Exhibition – however, with a phrase of warning that Parental discretion require for youngsters below 12 years (U/A)
  • Restricted to adults (A)
  • And also, Restricted to any unique elegance of individuals (S)

Provisions for Censorship:

  • Article 19(2) of the Constitution approves the government to impose, employing regulation. And also, Defamation or incitement to an offense.
